Welcome to Creative Owl. These Terms and Conditions (“Terms”) govern your access to and use of creativeowl.art (the “Site”), operated by Creative Owl (“Company”, “we”, “us”, or “our”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree with these Terms, please discontinue use of the Site immediately.

1. Overview of Services

Creative Owl provides a subscription-based service for delivering art and craft kits designed for creative expression. Each box may include curated materials, project ideas, and inspiration, delivered on a recurring basis. Some one-time purchases or digital products may also be offered through the Site.

2. User Accounts

To place an order, you must create an account using a valid email address and password. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Please notify us immediately if you suspect unauthorized access to your account.

3. Subscription Terms

By subscribing to Creative Owl, you authorize us to charge your selected payment method at the agreed-upon interval (monthly, quarterly, etc.). Your subscription will automatically renew unless canceled before your next billing cycle. You may cancel anytime through your account dashboard or by contacting us.

We may modify subscription pricing or product contents at any time. Price changes will be communicated in advance via email or notice on the Site.

4. Product Information & Safety

While we strive for accuracy, product colors, details, and contents may vary slightly from how they appear on the Site due to lighting, packaging updates, or availability.

Safety Warning: Craft kits may contain small parts or other materials not suitable for children under age 3. Always supervise young children during use. It is your responsibility to read and follow all included safety instructions.

5. Intellectual Property

All content on the Site—including text, graphics, logos, illustrations, videos, and designs—is owned by or licensed to Creative Owl and is protected by intellectual property laws. You may use the Site for personal, non-commercial purposes only. Reproduction or redistribution of any materials without our written permission is strictly prohibited.

6. Payment & Billing

All payments are processed in U.S. dollars. You agree to provide accurate and up-to-date billing and shipping information. We reserve the right to cancel or refuse any order for any reason, including suspected fraud, bulk resale, or payment failure.

Sales tax may apply based on your shipping address.

7. Returns & Refunds

Due to the nature of our products, all sales are final. We do not accept returns unless the item arrives damaged or defective. If your box arrives with missing or damaged components, please contact us within 7 days of delivery and we’ll work with you to make it right.

8. Limitation of Liability

Creative Owl is not liable for any indirect, incidental, or consequential damages resulting from the use of the Site or any products purchased through it. In no event shall our total liability exceed the amount paid by you for the product(s) in question.

You assume all risk associated with the use of our products, including any allergies, sensitivities, or adverse reactions related to included materials.

9. User Conduct

By using our Site, you agree not to:

Use the Site for unlawful purposes
Attempt to gain unauthorized access to our servers or systems
Interfere with the Site’s operation or other users’ experience
Submit false or misleading information
Copy, resell, or exploit any part of the Site without express written permission

10. Site Availability & Modifications

11. Dispute Resolution

Any disputes arising from your use of this Site or services will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. Arbitration will take place in the State of Minnesota unless otherwise mutually agreed. You waive your right to a jury trial.

The arbitrator’s decision will be final and binding. Exceptions to arbitration include intellectual property disputes or any legal matters that require immediate injunctive relief.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Minnesota, without regard to its conflict of law principles.

13. Indemnification

You agree to defend, indemnify, and hold harmless Creative Owl, its affiliates, and its employees from any claims, damages, or liabilities arising out of your misuse of the Site or violation of these Terms.

14. Termination

We reserve the right to suspend or terminate your access to the Site at our sole discretion, without notice, if we believe you have violated these Terms or engaged in inappropriate conduct.
